H-1B scam targets Indian visa seekers

Most of the attention regarding the H-1B visa program is on the impact it has on U.S. workers, but Indian workers face their own perils in deciding to seek a visa, as described by one blogger.

The writer, Brijesh, at the blog Uyarangalilekku (Scaling New Heights), who is from India and is working in Arizona, says H-1B seekers in India can be charged exhorbitant fees by consultants who promise to deliver an H-1B visa but don't. See: To All H1B Seekers – Beware of Hidden Traps.

He writes of two friends "who were cheated" in the H-1B process.

Brijesh closes this post by asking visa seekers to question the decision to come to the U.S.

With the declining dollar value and increasing job opportunities in India is it worthwhile to land in the US with a visa sponsored by a shady consultant, sit on bench for a long period of time and struggle to get a job?

Benching refers to a practice of not paying an H-1B visa holder between jobs.

An earlier post on this topic by Brijesh drew over 100 comments. Some of the commenters offer insight into the pressure they face to get an H-1B. Wrote one:

I am one of the unfortunate guys who are forced to get an H1B and come to work in US just for the fact that not planning to come into US makes you look "un-initiated" to your top management. I was forced to apply for H1 as if I did not I would look like a person who "doesn't take initative" "cannot take responsibilities" & "has issues with communication" as per my manager. So to save my career and not to painted as a slacker, I apply for an H1 and am here.

I have no wish or motivation to be here. True, I made some cash and got some cool gadgets here, but I had lived without it for the past 27 years and can do without it in the future too.

Please make the call. This is the right time to make the call. These days immigrations dept. is raiding companies for illegal activities.

Its not just the employer who is breaking the law, employees are supporting them too. As far as L1 visa interview goes, they know from the forum what questions they are asked and they know what to answer even if it is not the right answer.

For L1 visa they have to say they are working on a proprietary tool and have specialized skills to get the visa even if they don’t have those skills. This is fraud and they need to go to jail.

Remember the only way to stop these guys is by putting not 11 but atleast 1100 in jail. They can afford to pay as mush fine as required without any issues and still continue the same old unethical practice. It’s only the jail time that they are scared off and which will make them stop.

So guys if you are suspicious of any illegal activities on H1 or L1 please call ICE. You can call from public phone and don’t have to reveal your identity.

Please make the call. For those you already have a job, you may be the next one to get fired.

Immigrants leave countries

Immigrants leave countries in which they have very nice lives to come to the land of milk and honey. Only that--when they get here--they found out they have been mislead.

Very few people are intelligent enough to ask the question--ok, the US has a special visa for programmers. Is that because the US:

1. Likes programmers and wants to pay them well?

or

2. Hates programmers and wants to pay them poorly?

I think the immigration "problem" could be solved largely by presenting people accurate information about the life they're going to get when they come here.

After all, it doesn't do anyone any good to lie to people and have them make decisions based of false information, does it?

I didn't feel the need

I didn't feel the need respond to this ad-hominum attack because I felt the content of the post already reflected the exact blind stupidity that many immigrants have.

And by the way, most blindly stupid people are...ahem...losers.

P.S. "Land of opportunety (sp)" is not contained in any economics textbook I ever read. Most economists seem to think that the current "land of opportunity" (read: land with a high capital-labor ratio) is not defined as the "United States" but rather is a moving target and can change due to the movements of both capital and people.

I am sad for these exploited

I am sad for these exploited people. The corp. types at the top are the winners once again. They really have no ethics.

Having thought long and hard about this, I think we need to incentivize the hiring of Americans. Maybe the government could use some of those Billions they waste per year by paying some part of the salaries (giving companies tax credits)for every American worker they hire over a 3 to 5 year time frame. I really don't think we can win this except by appealing to the greed factor. sad isn't it?

Sure, H-1Bs are exploited. I can empathize with their problem, but I think we should focus more on the damage that is occuring to the American workforce as we continue to import cheap labor.
