Cartoon justice: Man convicted for Simpsons porn

Here I go again, out of the frying pan and into a three-alarm fire.

An Australian man has been convicted of possessing child porn for having lewd images of The Simpsons on his hard drive. Alan John McEwan has been fined A$3000 and placed on two years' probation, but he could have been sent away for up to 10 years. Per the Sydney Morning Herald:

McEwan appealed the decision arguing that fictional cartoon characters could not be considered people as they "plainly and deliberately" departed from the human form.... But Justice Adams agreed with the magistrate, finding that while The Simpsons characters had hands with four fingers and their faces were "markedly and deliberately different to those of any possible human being", the mere fact that they were not realistic representations of human beings did not mean that they could not be considered people.

So I have a question for the judge. If The Simpsons are real people, and they were all “born” in April 1987, doesn't that make them 21 years old?

Personally, I think anyone who abuses kids should be locked up for life, with no chance of parole. People who sell pictures of abused kids should occupy the cell right next door. But a potential 10-year sentence simply for downloading a photo – or a lewd cartoon – seems a bit extreme. That's just my personal opinion, not necessarily that of any other person, human or animated.

John Murrell of Good Morning Silicon Valley puts the issue in perspective far better than I can.

Child pornography is not a subject that lends itself to nuanced discussion. Healthy people know it's sick stuff, perpetrated and peddled by scum, and it would be hard to get an argument against any measure that could effectively cut the traffic and reduce the damage. But all issues have edges, and it's there, where drawing distinctions starts to get uncomfortable, that taking a sledgehammer approach can make things messier than the front row at a Gallagher show.

The fact is, in addition to the human stuff, the Net is a pornocopia of cartoon filth. It's easy to find SpongeBob without his SquarePants, and Lilo not wearing a Stitch. Betty, Wilma and teen Bam Bam; Daphne, Velma, and Scooby Doo; all of the Griffins from Family Guy; if you can imagine it, you can find it.

This is very clearly a violation of copyrights. But is it really the same as porn? Is it as titillating or as damaging? Should it be treated the same way under the law? I'm no lawyer, but I don't think so.

It's a very difficult topic to write and talk about, and I'm already in enough hot water with some of my readers for other things I've said. But I think we've become overwhelmed by hysteria, and it's time to dial it back and look at this stuff from a rational perspective.

FYI, If you do decide to search for these images, be very careful. Criminal prosecutions in this area have hinged on evidence as slight as a thumbnail image found in someone's browser cache. But that's a blog for another day.

I wouldn't be bothered looking for something like 'simspons porn' but what worries me is that if I had come across it by chance, it is something I might have had a gawk at for a laugh or just to see what the hell it was about.

It's pretty scary and concerning that mere curiosity could have led me to engage in what now appears to be an illegal act when I would never in a million years have entertained the possibility that it could be.

What's even more concerning is that the courts have seen fit to start treating cartoons as people! It's Big Brother gone insane and opens up all sorts of rediculous scenarios.

Who knows - I'm probably going to pop up on some 'watch' list for writing this since maybe that's breaking the law too. I mean WTF!

If cartoon characters are

If cartoon characters are considered to be real people, does that include violence, murder etc. if so, then no more Simpsons, South Park, Futurama, Family Guy, American Dad, most of Warner Brothers cartoons, Cat Dog, Rocko's Modern Life... the list goes on.

Back to the story... I think it's a bit harsh to convict people on cartoon representations, it's not like any children were abused, forced etc to take the pictures and not all the people who possess this type of material pedifiles in real life.

The Real Criminals

Have you noticed in the news the majority of people charged with Child Abuse are those people who are entrusted with others children?

Teachers,Priests,Childcare workers.
Also people of Authority The Police QC's Judges?

has aimed a comment to all people quote 'If we are not knocking on your door this morning, then it could be tomorrow' unquote

So big Brother is watching everyone if you look at children in the street or go to the local swimming pool on your own, watch out you may attract the attention of the Authorities.

Soon it will be a crime to wash your own child take photos of family events school photos may be banned and it goes on and on.

As for the Simpsons why have they not been arrested for Child Abuse? They are real people,why are they protected from the Law??
They abuse their children everyday and noone lifts a finger.

Surely there must have been

Surely there must have been some reason they were looking at his hard drive in the first place. They can't have just taken it just for the sake of it.

I am totally with you on that one...

....'cause we all know the government uses well-rationed, completely-legal reasons for everything they do.

Do be careful, though; watercooler word is that after all the towel-wearing evildoers are caught they're going to round up all the crazies next.

The biggest problem I see

The biggest problem I see with this is its misued logic and implications for other depictions of illegal acts. There's also potential hypocrisy here.

The judge ruled that these characters could be considered persons. Does that mean they are subject to the same rights as humans, which I suspect law defines as persons? If a character gets shot on the Simpsons are the artists guilty of committing murder? Does a graphic depiction of a person snorting cocaine in a movie make it illegal? Is the movie "Lolita" banned in Australia? This movie is sometimes heralded as a great work of art, even though it includes 'depictions' of underaged sex, though not really graphic. It seems you could take that logic and run with all the way to the crazy train, banning every visual representation of anything illegal because the representations are 'persons'.

But beyond that, the judge's reasoning was that this would fuel demand for real child pornography. Is there any evidence to suggest that? Anything that isn't merely correlation? Anti-violence activists have trumpeted their cause against music, video games and movies for a long time and in most circumstances, if I'm not mistaken, it's get thrown out. There has been no good science one way or the other to prove that violent video games make violent children. (Just research some of the highly praised tests that have 'proven' it, and you could be shocked at how pathetic they were.) This decision would only make an inkling of sense if there was evidence to prove beyond a reasonable doubt that looking at Simpsons porn would lead to purchasing real child pornography. Even then, I don't advocate punishing people until they do the real crime. We can't charge a person for drinking alcohol because it might lead them to do an illegal substance. If my logic here is flawed someone please show me.

all i have to say is this is really stupid i mean if this is the case then they should ban hentai im surprised no one even metioned it any ways im not the brightest person heince i dont use periods or anything but hentai is 1000 times worse then a stupid lil simpson jetson flintstone what ever cartoon where there nude thats all i have to say about that good day :)

Not saying I agree with

Not saying I agree with them, but I think the law is that it has to be a depiction of a character who is underage. Centain Simpsons characters, while all over the age of 21, are minors within their fictional context. Hentai of Sailor Moon, even though she appears to have an adult body, would be illegal because her character is under age of consent. Hentai of non-specific charactes can defend on the grounds that the character only looks like a minor because of the art style chosen or that the character's fictional background is that they magically stopped developing at a certain age and are therefore consenting adults who only look like children, being raped by tenticle monsters. For some reason, this is perfectly acceptable to put in a newsagent at a childs eye level.
